Free Cybersecurity Assessment Terms and Conditions
Introduction
This promotion (“Promotion”) offers a free cyber security assessment to eligible businesses and is governed by the following terms and conditions (“Terms”). By participating in the Promotion, entrants agree to be bound by these Terms.
Promoter’s Details
The Promoter (“Promoter”) of the assessment is Just Protect Pty Ltd ACN 681 346 225.
The Promotion
The promotion involves receiving one (1) free introductory cybersecurity assessment (“Assessment”), which will assess the existence of basic cybersecurity controls and perform a high-level overview of key risks and recommendations.
Participant Eligibility
To qualify for this Promotion, businesses (“Participants”) must:
- Be classified as a Health Service Provider under the definitions of the Privacy Act.
- Be registered in Australia with a valid Australian Business Number (ABN).
- Be actively trading at the time of entry.
- Employ fewer than 50 individuals.
- Comply with all Promotion procedures and requirements.
- Meet other criteria as determined by the Promoter.
Promotion Period
The Promotion commences on 01 January 2025 and concludes on 30 June 2025. However, the promotion period may be changed at any time at the Promoters discretion and without notice.

Assessment Scope and Limitations
The cyber security assessment is a basic, introductory and high-level evaluation of the participant business’s current cyber security measures based upon the participants answers to a questionnaire. The assessment is not an exhaustive analysis. The assessment may provide a series of results regarding the participant’s risk levels, which are entirely derived from the information provided by the participant. These communicated risks and risk levels do not consider factors or information outside of the information provided by the participant and thus are not considered to be a fully representative assessment of the participant’s organisational risk levels, but rather an introductory and high level assessment.
The Promoter accepts no responsibility or liability for:
- The completeness or effectiveness of the assessment provided.
- The completeness or effectiveness of the risks identified.
- The completeness or effectiveness of the cybersecurity recommendations provided to the participant.
The assessment is provided ‘as is’ without any warranty. The Promoter makes no guarantees or warranties, express or implied, regarding the security of participants’ business operations.
Participants acknowledge that the responsibility for their cyber security remains entirely with them, regardless of any advice or information provided as part of the assessment.
Participant Obligations
By entering the Promotion, participants agree to:
- Provide true, accurate, and complete information about their business as requested by the Promoter.
- Cooperate promptly with the Promoter and provide all necessary information and access required to conduct the assessment.
- Acknowledge that failure to comply with this clause may result in disqualification from the Promotion or non-receipt of the assessment.
Liability
To the fullest extent permitted by law, the Promoter:
- Excludes all conditions, warranties, and guarantees implied by custom, law, or statute.
- Disclaims all liability, including direct, indirect, or consequential damages, loss of profit, loss due to business interruption, any loss arising from any negligent act or omission of the Promoter, or loss of opportunity, arising out of or in connection with the Promotion or Assessment.
- Excludes all liability for any Assessment not fulfilled or completed.
The Assessment is conducted based on the information provided at the time of the Assessment, utilising an automated technique and is subject to time constraints. The absence of identified issues during the Assessment does not necessarily indicate the non-existence of such issues. The Assessment is not guaranteed to be entirely accurate or exhaustive, nor are the risks identified. Should the participant fail to provide accurate answers and information, the accuracy of the Assessment results will be negatively impacted. Furthermore, the results of the Assessment should not be relied upon or used as a basis for making any decisions without obtaining specific, express advice. Any reliance on the results of the Assessment is at the participant’s own risk. Just Protect shall not be held liable for any decisions made or actions taken by the Customer in reliance upon the results of the Assessment. Participants acknowledge that the responsibility for their cyber security remains entirely with them, regardless of any advice or information provided as part of the assessment. Just Protect is not liable for any damages or claims arising from a cybersecurity breach or cybersecurity incident that occurs at the participants business.
The Promoter’s liability for failure to comply with a Consumer Guarantee is limited to the resupply of the promotional assessment.
Indemnification
The participant shall indemnify, defend, and hold harmless the Promoter, its affiliates, and their respective officers, directors, employees, and agents (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, losses, damages, expenses, and costs (including reasonable attorneys’ fees) arising out of or relating to: Any breach by the Participant of its obligations under this Agreement; The Participant’s use of the services provided by the Promoter, including any third-party claims arising from such use; Any negligence or willful misconduct by the Participant or its employees, agents, or contractors; Any failure by the Participant to comply with applicable laws, regulations, or industry standards.
Confidentiality
A Party which receives Confidential Information (Recipient) from the other Party (Discloser) must keep the Discloser’s Confidential Information confidential and not deal with it in any way that might prejudice its confidentiality.
The Recipient’s obligations in relation to the Confidential Information will continue for as long as the Confidential Information is maintained on a confidential basis by the Discloser.
The Confidential Information does not include information which is generally available in the public domain otherwise than as a result of a breach of clause 11.1 by the Recipient; or was known by the Recipient prior to the Discloser disclosing the information to the Recipient.
The Recipient agrees to indemnify the Discloser fully against all liabilities, costs and expenses which the Discloser may incur as a result of any breach of this clause 11 by the Recipient.
The Recipient acknowledges that damages may be an inadequate remedy for breach of this clause 11 and that the Discloser may obtain injunctive relief against the Recipient for any breach of this clause 11.
The obligations accepted by the Recipient under this clause 11 survive termination or expiry of this agreement.
Intellectual Property
The Participant acknowledges that any and all copyright, trademarks, and other intellectual property rights used in or subsisting in connection with the Promotion or Assessment and any parts thereof are and shall remain the sole property of Just Protect. This includes any Background IP and Contract IP.
- Background IP means the Intellectual Property of a Party which was in existence prior to the commencement of this agreement or which is subsequently developed by that Party independently of and for purposes unconnected with this agreement.
- Contract IP means Intellectual Property created by the Consultant in the course of performing its obligations under this agreement.
- Intellectual Property includes trademarks, patents, copyrights, processes, know-how, registered designs, or other like rights or any right to apply for registration of any of the former.
The Participant shall not, during or at any time after receiving the Assessment, question or dispute the ownership thereof by Just Protect, nor perform any act inconsistent with the rights of Just Protect.
Privacy
All personal information submitted by participants will be handled in accordance with the Promoter’s privacy policy and applicable Australian privacy legislation. Information will be used for conducting this Promotion and may be used for promotional, marketing, or publicity purposes without additional compensation.
Disputes
These Terms are governed by the laws of Victoria, Australia. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
Right to Modify or Cancel
The Promoter reserves the right to cancel or amend the Promotion and these Terms without notice, at the Promoter’s sole discretion and without penalty.
Not Legal Advice
Nothing in this Promotion or the Assessment constitutes legal advice. The information provided during the Promotion and as part of the Assessment is for general informational purposes only and should not be relied upon as legal advice. Participants are encouraged to seek independent legal counsel for any legal matters or concerns.
Participant Acknowledgement
Participants agree that they have read, understood, and accepted these Terms and Conditions in their entirety prior to their participation in the Promotion.
